These Terms & Conditions govern your access to and use of our website, platforms, applications, WhatsApp Official API services, RCS messaging solutions, and related communication services (collectively, the “Services”).

• “Platform” refers to systems, dashboards, APIs, and tools provided by Atharv Communication.
• “Meta” refers to Meta Platforms Inc., including WhatsApp Business services.
• “RCS” refers to Rich Communication Services enabled via telecom operators.

Acceptance of Terms

By registering, accessing, or using any Services provided by Atharv Communication, you expressly accept these Terms & Conditions, our Privacy Policy, and any additional guidelines communicated from time to time. These terms constitute a legally binding agreement under the Indian Contract Act, 1872.

Description of Services

Atharv Communication provides cloud-based communication solutions including but not limited to:

• WhatsApp Official API onboarding and messaging services
• RCS messaging solutions through authorized telecom operators
• Transactional, promotional, and service-based messaging
• Customer engagement and notification systems
• Compliance-driven business messaging infrastructure

All Services are subject to approval by Meta, telecom operators, and applicable regulatory authorities.

Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Have legal capacity to enter into contracts
• Be authorized to represent your business entity
• Comply with all applicable Indian laws, TRAI regulations, Meta policies, and telecom rules

Atharv Communication reserves the right to deny service to any user not meeting eligibility requirements.

Account Registration

Users may be required to create an account and submit valid business information, identity documents, and compliance details. You agree to:

• Provide accurate and up-to-date information
• Maintain confidentiality of login credentials
• Accept responsibility for all activities under your account

Atharv Communication is not liable for unauthorized access due to user negligence.

User Responsibilities

Users agree not to:

• Send spam, fraudulent, or misleading messages
• Violate WhatsApp or RCS messaging policies
• Transmit unlawful, obscene, or harmful content
• Use purchased data without recipient consent

Users must ensure opt-in consent before messaging recipients.

Payment & Billing Terms

All fees are communicated upfront. Payments must be made in Indian Rupees unless otherwise specified.

• Fees are non-refundable unless stated
• Taxes (GST) are applicable as per Indian law
• Failure to pay may result in service suspension

Subscription Renewal & Termination

Subscriptions may auto-renew unless cancelled. Atharv Communication reserves the right to suspend or terminate services for policy violations, non-payment, or regulatory non-compliance.

Use of WhatsApp Official API & RCS

Users acknowledge that WhatsApp and RCS services are governed by third-party platforms. Atharv Communication does not control message approval, delivery, or template rejection by Meta or telecom operators.

Message Delivery & Compliance Policy

Message delivery depends on:

• Recipient device availability
• Network conditions
• Platform approval

Atharv Communication does not guarantee 100% delivery.

Intellectual Property Rights

All software, documentation, trademarks, and materials are the intellectual property of Atharv Communication or its licensors. Unauthorized use is strictly prohibited.

Confidentiality

Both parties agree to maintain confidentiality of proprietary information, business data, and trade secrets.

Disclaimer of Warranties

Services are provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

Limitation of Liability

Atharv Communication shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data.

Indemnification

Users agree to indemnify and hold harmless Atharv Communication from claims arising out of misuse of Services or policy violations.

Governing Law (India)

These Terms are governed by the laws of India. Courts in Ahmednagar, Maharashtra shall have exclusive jurisdiction.
